All parents/guardians must ensure that they read the following Terms and Conditions of Enrolment before they enrol. Please note that once your registration has been accepted by Examberry the following terms and conditions apply.
Fees
- Prices are correct at time of registration and are subject to change without notice.
- Fees include all class tuition, course materials and homework. Fees are payable in advance by Direct Debit on a monthly basis.
- If any payment is not made by the due date, a charge of 10% of the outstanding instalment(s) will be levied automatically.
- Should the payment schedule not be adhered to at any time and the child continues to attend lessons, Examberry Tuition Ltd will be entitled to end any agreement to pay by instalments and to demand that all outstanding payments, together with the payment of the remaining balance of the total course fees, are paid in full immediately.
- Failure to pay any instalment may result in the student being excluded from further classes.
- Courses prepaid in full in advance are non-refundable.
Fees do not include specialist or extra lessons.
Commencement of Tuition
- On payment of the deposit or registration fee, which is non-refundable, Examberry will reserve a place for your child on your selected course, which is done strictly on a first come first serve basis.
- A child may only attend classes once Examberry Tuition Ltd. has received either payment via direct debit or full payment.
- Examberry reserves the right to change the times of the courses, and to make changes in regulations, syllabus, fees, etc. without prior notice.
- Examberry do not guarantee in any way that the tuition will enable the student to pass the relevant exams or achieve entrance to their desired schools.
Termination Policy: Year 3, 4 and 5 Term-Time Courses
- If for some unexpected reason you wish to withdraw your child from lessons, cancellations are are subject to one month’s notice in writing, unless otherwise stated.
- The course fee deposit will be retained and is not transferable.
- The balance of fees is calculated to the end of the month of the last attendance by the pupil. If a pupil is withdrawn part way through the month, full payment for that month is charged.
- All books and materials belonging to Examberry remain the property of Examberry and may need to be returned before departure.
Termination Policy: Year 6 Independent School Course
- Fees paid for the Year 6 Term-Time Course are non-refundable.
Termination Policy: Year 6 Stage 2 Grammar School Masterclass
- If you cancel with more than 1 week’s notice we will return your first payment less a £50 admin cancellation fee. Cancellations within 7 days of the course starting will incur a 25% charge.
Termination Policy: Summer Year 4 & 5 Intensive Courses
- Cancellations must be made with 10 working days notice and will incur an administrative fee of £50. Cancellations made within 10 working days will incur a 25% charge.
Termination Policy: Summer Writing Workshops
- Cancellations are subject to a charge of 50% of the course fee if this occurs within 7 days of the course starting.
Pupil Safety
- The safety of our pupils is of paramount importance.
- Children should be brought into and collected from the tuition centre reception at the beginning and end of each class. To ensure your child’s safety, children must not leave the building unless they are accompanied by a parent/guardian.
Parents Guidelines
- Please arrive promptly for classes, 10 minutes before your class starts, so that the tutor can greet the children and the lesson can begin on time. The tutors will be available to talk briefly to parents after the class if required.
- Please collect your child promptly. Kindly note a charge of £10 may be applied if you are running more than 15 minutes late to collect your child to cover our time.
Material
- All teaching material is provided during the course and is included in the course fee.
- We do not offer temporary class swaps, students are required to complete a missed lesson’s classwork and homework with the aid of pre-recorded videos available through our online portal.
- Replacement copies of lost/damaged books will be replaced at
the client’s expense. - All Examberry course materials are subject to copyright. Photocopying or any other means of electronic reproduction are strictly prohibited without written permission from Examberry Tuition Ltd.
What happens if my class falls on a Bank Holiday Monday?
- If your class falls on a Bank Holiday Monday you will be contacted in advance and offered an option to either have your class on the Bank Holiday Monday or to reschedule it to a different day.
Missed Lessons
- Examberry must be notified promptly of any absences through illness. Examberry must be notified of suspected or known infectious diseases so that appropriate action can be taken.
- If a lesson is cancelled by Examberry Tuition Ltd, an extra-help session(s) will be arranged to replace it.
- It is a basic stipulation of the agreement between the student/parent/guardian and Examberry or its representatives that neither Examberry nor its representatives are liable to the student in cases where Examberry is unable to fulfill any services to which they are contractually bound because of strikes or other reasons that are beyond their control. This includes traffic congestion and public transport delays.
Personal Property
- Examberry accepts no responsibility or liability for personal accident or loss or damage of property. You are strongly advised to take out personal insurance.
Safeguarding Policy
Examberry Tuition recognises that because of the day to day contact with children, centre staff are well placed to observe the outward signs of abuse. The setting will therefore:
- Establish and maintain an environment where children feel secure, are encouraged to talk, and are listened to.
- Ensure that children know there are adults in the centre whom they can approach if they are worried.
Examberry Tuition recognises that children who are abused or witness violence may find it difficult to develop a sense of self-worth. They may feel helplessness, humiliation and some sense of blame. The setting may be the only stable, secure and predictable element in the lives of children at risk. When at the setting their behaviour may be challenging and defiant or they may be withdrawn. The setting will endeavour to support the member through:
- The setting ethos which promotes a positive, supportive and secure environment and gives members a sense of being valued.
- The setting has a behaviour policy. The centre will ensure that the students know that some behaviour is unacceptable but they are valued and not to be blamed for any abuse which has occurred.
- Liaison with other agencies that support children such as Social Services, Education Welfare Service and Educational Psychology Service.
- Ensure that children know there are adults in the centre whom they can approach if they are worried
Safeguarding Procedures
Examberry Tuition follows the procedures set out by the Local Safeguarding Children Board and take account of guidance issued by the Department of Education and Skills to ensure:
- All staff and visitors must sign in and out so everyone is accounted for at all times for both fire and safeguarding regulations.
- Visitors, including parents, must be supervised by a member of staff at all times.
- Staff or Visitors with a criminal conviction or pending criminal investigation, in relation to children or sexual assault will not be allowed access to the classrooms.
- Examberry Tuition has a Designated Safeguarding Officer (Lydia Dower) who has received appropriate training and support for this role.
- Every member of staff (including temporary staff) knows the name of the Safeguarding Officer responsible for safeguarding, and their role.
- Ensure all staff understand their responsibilities in being alert to the signs of abuse and responsibility for referring any concerns to the designated senior person responsible for safeguarding.
- Ensure that parents have an understanding of the responsibility placed on the setting and staff for safeguarding by setting out its obligations in the settings Policies &Procedures (e.g. parents are not to leave their children unsupervised at our tuition centres outside of tuition hours).
- Develop effective links with relevant agencies and co-operate as required with their enquiries regarding safeguarding matters including attendance at case conferences.
- Keep written records of concerns about children, even where there is no need to refer the matter immediately.
- Develop and then follow procedures where an allegation is made against a member of staff, in line with our Procedures for dealing with allegations or concerns about a staff member’s policy.
- Ensure safe recruitment practices are always followed.
- Ensure that safeguarding is an embedded and integral part of the operational practices of our organisation and that everyone working within our organisation understands their responsibilities in relation to safeguarding.
CCTV Policy
- Purposes
1.1 Examberry uses closed-circuit television (CCTV) for the prevention, identification and reduction of crime and to monitor tuition centres in order to provide a safe learning environment for staff and students.
1.2 CCTV surveillance at the Centres is intended for the purposes of:
- protecting the tuition buildings and assets, both in and out of tuition hours;
- promoting the health and safety of staff and students;
- preventing bullying;
- reducing the incidence of crime and anti-social behaviour (including theft and vandalism);
- supporting the Police to deter and detect crime;
- safeguarding; and
- assisting in identifying, apprehending and prosecuting offenders.
1.3 The CCTV system is owned and operated by Examberry.
1.4 The CCTV system is monitored by Lydia Dower, Head of Tuition and Divya Vassa, HR Manager.
1.5 Examberry’s CCTV system is registered with the Information Commissioner under the terms of the Data Protection Act. This policy outlines the company’s use of CCTV and how it complies with the act.
- SCOPE
2.1 Examberry has one security camera in the New Malden centre (at the back of the classroom with view outside the windows and the door).
2.2 The system will provide a 28 day rolling recording over these areas.
2.3 Cameras will be sited so they only capture images relevant to the purposes for which they are installed and care will be taken to ensure that reasonable privacy expectations are not violated.
2.4 Examberry will ensure that the location of equipment is carefully considered to ensure that images captured comply with the Data Protection Act.
2.5 CCTV Video Monitoring and Recording of Public Areas may take place for the following purposes:
- protection of tuition buildings and property: the building’s perimeter, entrances and exits, lobbies and corridors, special storage areas, office locations, receiving areas for goods/services;
- monitoring of access control systems: monitor and record restricted access areas at entrances to buildings and other areas;
- video patrol of public areas: parking areas, main entrance/exit; and
- criminal investigations (carried out by police): robbery, burglary and theft surveillance.
2.6 Examberry complies with Information Commissioner’s Office (ICO) CCTV Code of Practice to ensure it is used responsibly and safeguards both trust and confidence in its continued use.
2.7 The use of the CCTV system will be conducted in a professional, ethical and legal manner and any diversion of the use of CCTV security technologies for other purposes is prohibited by this policy e.g. CCTV will not be used for monitoring employee performance.
- SIGNAGE/NOTIFICATION
3.1 Signs will be displayed outside the classroom and inside the classroom.
3.2 This policy will be provided on request to staff and customers, and made available on the website to ensure staff, parents and students have access.
- RETENTION PERIOD AND BACKUP
4.1 Images will be retained for a maximum of 28 days, except where the image identifies an issue and is retained specifically in the context of an investigation / prosecution of that issue. Images will be deleted automatically after 28 days.
4.2 The images will be stored in a secure password-protected environment with a log of access kept.
4.3 Any footage that shows a crime will be kept as long as it is needed to undertake criminal proceedings.
4.3 Access will be restricted to authorised personnel. Supervising the access and maintenance of the CCTV is the responsibility of the Director. The Director may delegate the administration of the CCTV system to another staff member.
4.4 In certain circumstances, the recordings may also be viewed by other individuals in order to achieve the objectives set out above. When CCTV recordings are being viewed, access will be limited to authorised individuals on a need-to-know basis.
4.5 Files will be securely stored in an encrypted environment. Access will be limited to authorised personnel and password protected.
4.6 There will be regular audits of system security.
- DISCLOSURE OF CCTV FOOTAGE
5.1 Recorded footage and monitoring equipment will be securely stored. The area will be locked when not occupied by an authorised member of staff.
5.2 When accessing images, two authorised members of staff will be present. Records of access will be kept.
- REQUEST FOR ACCESS OF CCTV FOOTAGE
6.1 Individuals have the right to request access to CCTV footage relating to themselves under the data protection act.
6.2 Individuals submitting requests for access will be asked to provide sufficient information to enable the footage relating to them to be identified. For example, date, time and location.
6.3 Examberry will respond to requests within 30 calendar days of receiving the request.
6.4 Examberry reserves the right to refuse access to CCTV footage where this would prejudice the legal rights of other individuals or jeopardise an on-going investigation.
6.5 A record of the date of the disclosure along with details of who the information has been provided to (the name of the person and the organisation they represent) and why they required it will be made.
6.6 In giving a person a copy of their data, Examberry will provide a still/series of still pictures, a tape or a disk with relevant images. However, other images of other individuals will be obscured before the data is released.
6.7 Where footage contains images relating to 3rd parties, Examberry will take appropriate steps to mask and protect the identities of those individuals.
